1. About Vidpitch

Vidpitch (vidpitch.com) is a software tool that helps you create personalised video campaigns by combining a recorded webcam clip with dynamically captured website screenshots. These Terms govern your access to and use of the Vidpitch web application and any associated services.

2. Acceptable Use

You may use Vidpitch only for lawful purposes and in accordance with these Terms. You agree not to use the service to send unsolicited messages (spam), to harass, abuse, or harm any person, or to violate any applicable law or regulation.

You are responsible for ensuring that your use of Vidpitch complies with all applicable laws and regulations in your jurisdiction, including but not limited to those governing electronic communications and data protection.

3. Outreach Responsibility

You are solely responsible for the lawfulness of your outreach. Vidpitch is a tool — it is not the sender of record for any message or campaign you create. Responsibility for obtaining valid consent, establishing a lawful basis for processing under the GDPR or equivalent privacy law, complying with CAN-SPAM, CASL, or any other anti-spam or email marketing regulation, and honouring opt-out requests rests entirely with you.

Vidpitch makes no representation that your campaigns comply with applicable law. We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of applicable law or these Terms.

4. Intellectual Property

The Vidpitch service, including its software, design, and content, is owned by Vidpitch and its licensors. You retain all rights to the content you upload (webcam recordings, CSV data, and the resulting videos). By using the service you grant Vidpitch a limited licence to process your content solely to provide the service to you.

5. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Vidpitch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

7. Termination

We may suspend or terminate your access to the service at any time, with or without cause, with or without notice. You may delete your account at any time through the account settings page. Upon termination, your right to use the service will cease immediately.

8. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email. Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
